ITEM:  AMENDMENT PLAN - 1400 Mill Creek Road, Gladwyne, Barkers Mill, Ward 2

Consider for denial a request from 1400 Millcreek Road Associates, LP, for an extension of the twelve month period for Final Plan approval for the amended preliminary land development plan for the property at 1400 Mill Creek Road approved May 16, 2018, such denial recommended as the applicant failed to demonstrate compliance with Chapter 135-13 (B)(1) (a) through (c) of the Subdivision and Land Development Code based on the following standards:

 

a.    That one or more conditions existent at the time of preliminary plan approval have changed.

 

b.  That such change of circumstances was beyond the applicant's control and has prevented submission of the final plan within the twelve-month period.

 

c.    The applicant has failed to demonstrate that the circumstances preventing the filing of the final plan have been overcome or will be overcome in the foreseeable future.
