ITEM:  CONDITIONAL USE APPLICATION - 1400 Mill Creek Road, Gladwyne, Barker’s Mill, Ward 2, 3634C & 3634AA

Consider for approval a request to reconfirm a previously approved conditional use application to convert the two existing mill buildings into condominiums and construct a new condominium building for a total of 33 new residential units. Conditional Use approval was granted to convert the existing nonconforming, nonresidential Class 1 historic resources to multifamily use and to increase the building area of the site by up to 15%.

RESOLUTION

 

WHEREAS, the Township of Lower Merion received application #3634C from Kevin Kyle of Mill Creek Road Associates, LP, proposing to reconfirm a previously approved conditional use application to convert two existing mill buildings at 1400 Mill Creek Road, Gladwyne, Ward 2, known as Barker’s Mill, into condominiums and construct a new condominium building for a total of 33 new residential units; and

 

WHEREAS,  Conditional Use approval was previously granted to convert the existing nonconforming, nonresidential Class 1 historic resources to multifamily use and to increase the building area of the site by up to 15% as shown on plans prepared by Momenee Inc., dated February 18, 2005, last revised December 18, 2017.

 

WHEREAS, the application was referred to Pamela M. Loughman, Esq., Hearing Officer, to take testimony and make recommended Findings of Fact, Conclusions of Law and an Order for the consideration of the Board of Commissioners; and

 

WHEREAS, following a hearing on the application, the Hearing Officer prepared and has submitted to the Board of Commissioners her Report in the form of a document styled “Recommendations for Findings of Fact, Conclusions of Law and Order” whereby the Hearing Officer recommends that the application be granted subject to conditions; and

 

WHEREAS, the Board of Commissioners, having reviewed and considered the Hearing Officer’s Report, wishes to render its decision.

 

NOW THEREFORE, the Board of Commissioners of the Township of Lower Merion hereby resolves that the Findings of Fact and Conclusions of Law set forth in the attached Report of Pamela M. Loughman, Esq., Hearing Officer, be and the same are hereby adopted as the Findings of Fact and Conclusions of Law of the Board of Commissioners in the matter of the application of Kevin Kyle on behalf of Mill Creek Road Associates LP. 

 

The Board deems the following order to be appropriate:

AND NOW on this 16th day of May 2018 application 3634C for conditional use approval is granted and the previous grant of conditional use is reconfirmed based on the documents and plans submitted in support of the application, all of which are specifically incorporated herein by reference thereto.
